I. Who can Work in Japan

Visas in Japan can be divided in two categories, "activities visa"s and "resident visa"s.

A "resident visa" holder like a "spouse visa" or a "permanent resident visa" can choose its job and work in Japan freely, principally.

"Activities visa"s can be divided further more to "working visa"s and "non-working visa"s.

A "working visa" holder can certainly work in Japan with a permitted job. 

A "non-working visa" holder, like "dependent visa" or "student visa" cannot work principally, while it is able to apply for working permission when the visa holder wants to have a part time job.

II. Permission for Part Time Job or Side Job

A. Part Time Job for a "Student" Visa Holder

A "student visa" holder can principally get permission to its application for part time work within twenty eight hours per week or within eight hours a day in a long term vacation, if each of the following conditions meets: 

a) The part time work shall not prevent achievement of activities under the current visa. 

b) The applicant maintains activities defined for the current activities. 

c) The applied activities shall not be illegal, shall not be executed in a facility defined in Adult Entertainment Business Act「風俗営業等の規制及び業務の適正化に関する法律」or shall not be activities of  "non-store sexual adult entertainment business" defined in Adult Entertainment Business act. 

d) An order of detention has not issued to the applicant. 

B. Part Time Job for a "Dependent" Visa Holder

A "dependent visa" holder can principally get permission to its application for part time work within twenty eight hours per week.

C. Side Job for a Working Visa Holder

A "working visa" holder can also apply for working permission when the visa holder wants to have a side job which is not permitted by the currently held working visa.

III. How to Apply for Permission for " Activities other than Granted".

Working permission mentioned above is called as “permission to engage in activity other than that permitted under the status of residence previously granted”(「資格外活動許可」) regardless of the visa held by its applicant.

It is required to file the following documents to a regional immigration services bureau under the Immigration Services Agency of Japan("ISAJ")「出入国在留管理庁」in order to apply for "permission to engage in activity other than that permitted under the status of residence previously granted":

A. an application form in a regulated format("APPLICATION FOR PERMISSION TO ENGAGE IN ACTIVITY OTHER THAN THAT PERMITTED UNDER THE STATUS OF RESIDENCE PREVIOUSLY GRANTED"「資格外活動許可申請書」)

B. documents to clarify contents of activity to be made

It is also principally necessary to show the passport and the residence card of the applicant on filing the application,

unless the applicant hires a registered legal specialist like a registered "gyoseishoshi" lawyer or an immigration lawyer and the lawyer bring the passport and the residence card of the applicant to the regional immigration bureau on behalf of the applicant.

The secretary of ISAJ is authorized to determine, in its discretion, if the application should be permitted or not, and is also authorized to add conditions to the permission. 

When the application is permitted, a "certificate of permission to engage in activity other than that permitted under the status of residence previously granted"「資格外活動許可書」in a regulated form shall be issued or a stamp shall be put on the passport of the applicant or the certificate of eligibility of the applicant which should show the permission.

If the applicant lives in Japan in a middle or long term stay", in place of the above, it is required that the items on the residence card of the applicant should be rewritten.

* The fee to us shall be the same whether the application is files via the internet or by attending the regional immigration services bureau, as it is necesssary to go to the regional immigration bureau when receiving the result.
